HIGH PROFILE CRIMINAL CASE. THREE BABIES LOOSE THEIR MOTHERS.

Vadim Vassilenko, 40, a Ukrainian citizen, his wife Yelena Barysheva, 42, a Russian citizen and the New York State Corporation “Western Express” they own, are scheduled to be arraigned on November 7, 2007 (unless rescheduled) in Manhattan Supreme Court part 42 at located at 111 Center Str., New York, NY 10013 before Honorable Judge Maxwell Wiley with at least 172 counts of indictments related to their business activities. Both are facing forfeiture of $48 million if convicted, as well as at least 170 years in prison if convicted.

A couple voluntarily surrounded their permanent residence status in the United States this summer. According to the immigration Judge they were not deportable from the United States for no compliance with the New York State Banking Laws. Russian and Ukrainian diplomats were involved to keep to grant deportation for their citizens and acted accordingly to the Vienna Convention on a Consular Relations. Both consulates were not informed of the arrest of their citizens by the police in a violations of International Laws. A couple was charged in February 15, 2006 for Violation of New York State Banking Laws (unlicensed check cashing; unlicensed money transmitting) which is the lowest felony (E) and misdemeanor. They accepted a plea bargain and were sentenced on September 22, 2006 up to 1-3 years in prison for Yelena Barysheva and 2-6 years in prison for Vadim Vassilenko.

Vadim Vassilenko made his merit board for exception on a good behavior at Bare Hills Correctional Facility and was released on October 10, 2007 to Batavia Immigration Detention Center for scheduled deportation to Ukraine. On October 24, 2007 he was brought back to New York City to face new charges. He is detained at Manhattan Detention Center at 125 White str.

Vadim Vassilenko has lived in United States since 1992 and is educated as a piano teacher in Ukraine. Being influent by jazz music broadcasted by “Voice of America” he had a dream since his youth about coming to the United States to realize his potentials. Believing for everything he heard from the “Voice of America” radio programs in the US whatever is not prohibited, is permitted, as oppose to the Soviet Union where whatever is not permitted, is prohibited. He rented an office in the Empire State Building, working 70 hours a week with seed capital of just $20 which he deposited to his company’s first bank account in April 1994.

As his business grew, in 1997 he was approved for his permanent residence status as a person with exceptional abilities in business (I-94 form). Vadim Vassilenko is a very ambitious person and very well educated in financial and business matters, is denying all known connections to allegedly illegal activities. He is a market maker and exchanger for fast growing digital currencies and gold currencies market which were designed as an alternative to almost monopolistic and inefficient use of credit cards when paying on-line or wireless. State Federal and International Regulations on digital currencies are not clear. Law books do not contain even the definition of a digital currency. Very few attorneys are specializing in this new are of business.

A numerous values were ceased from a couple including corporate funds, life time savings, IRA account as well as significant part of their customers money. More than 5 other businesses not related to the charges ran by a couple were also destroyed. Company’s employee Tatyana Goloborodko, Ukrainian citizen, was arrested on October 10, 2007 and detained at Rikers Island since then. Tatyana is 8.5 month pregnant and has a 1 year old son, Ivan. She is expected to deliver her baby in a prison hospital and immediately expected to testify on trial.

Vadim Vassilenko owned a popular blog “www.dengiforum.com”, where he is being a believer in democracy and a free speech from his youth has written more than 5,000+ most various controversial topics assuming that he has arrived to speak his mind. His writings were partially translated from Russian and presented out of contests and than used against him in his indictment papers by prosecutors. Vadim Vassilenko and Yelena Barysheva have a 4 year old son in Ukraine where he is experiencing a numerous health problems in a result of a psychological trauma and forceful separation during his mother’s arrest 2 years ago. A couple was very cooperative at the day of their arrest on February 15, 2006 with authorities and offered an additional cooperation with through their attorney Daniel Gotlin (Ph: 212-966-5897) on July 2006, but were turned down by prosecutors. Pro bono attorney is expected to represent a couple on Wednesday November 7, 2007.
